Building Permit service – all building classes

Building Permits serve as official authorization to commence construction activities or implement a change of use, and they must be acquired prior to initiating any construction endeavours. Virtually all construction projects necessitate a Building Permit for progression.

Issuance of Building Permits is contingent upon the submission of plans and documentation meeting the criteria outlined in the following regulations:

  • Building Code of Australia 2022
  • The Building Act 1993
  • Building Regulations 2018

The Building Permit guarantees that the ensuing construction adheres to the aforementioned requirements.

It’s important to note: The Building Act stipulates penalties for individuals or entities undertaking construction work without a valid Building Permit. Similar to how a driver’s license grants permission to operate a vehicle, a Building Permit authorizes the execution of building work. It’s strongly advised to obtain the necessary permits beforehand, as substantial penalties are applicable for any infractions.

Performance Solutions

A Performance Solution offers an alternative route to meet the requirements outlined in the Building Code of Australia (NCC). The NCC operates on a performance-based system, where adherence to performance standards can be shown either through following the specific (deemed-to-satisfy) guidelines provided in the Building Code or by crafting a performance solution. While a Performance Solution may deviate, wholly or partially, from the Deemed-to-Satisfy Provisions, it must still fulfill the Performance Requirements, provided there is clear demonstration of how these requirements will be met.

Illegal building works / council building notice and orders

Illegal building works refer to construction activities undertaken without obtaining the necessary Building Permit beforehand. In cases where the local council becomes aware of such non-compliance, they may issue a Building Notice or Building Order, prompting justification for why the unauthorized works should not be demolished. Subsequently, you will need to enlist the services of a Building Surveyor to assess whether your unlawfully constructed structure meets compliance standards or identify necessary actions to render it compliant.

Applications for Variation to Part 5 of the Building Regulations

You can make an application to Council to change a standard in Part 5 of the Building Regulations 2018.

Part 5 standards are:

  • Daylight to existing habitable room windows (Regulation 81)

Section 29A Report and Consent (Demolition works)

Report and Consent must be granted by the Municipal building surveyor under Section 29A of the Building Act 1993 for certain demolition works.

This must happen before starting any work that results in clearing, altering or adding to a building that will either:

  • result in a change to 50 per cent of the building volume in a 3 year period
  • cause alterations to the facade of a building.

The definition of facade covers includes:

  • an external wall, including any verandah, balcony or balustrade or architectural feature attached to or forming part of an external wall
  • a part of a roof, or
  • a chimney that faces a street and at least part of which is visible from the street it faces.

The definition of street includes any:

  • road
  • highway
  • carriageway
  • square
  • court

A separate request must be sent to the Executive Director of Heritage Victoria when proposing to demolish or alter a building registered under the Heritage Act 1995.

Building over an Easement Report and Consent

Buildings or structures over an easement need consent before being built or placed. The legal definition of an easement is ‘the right to cross or otherwise use a portion of someone else’s land’.

Consent must come from Council where we are the relevant authority, and also from any other relevant authorities, such as water, electric or gas. Relevant authorities are nominated on your Certificate of Title.

Make sure there is a copy of consent from other relevant authorities before applying to Council.

Any building or structure placed over an easement is likely to require a building permit. This is unless it is exempt by the Regulations.

We aim to provide the outcome of building over easement requests within 10 business after receiving a complete application.

Hoarding Report and Consent (Public Protection)

Hoarding is temporary fencing that protects the public during construction.

At all times, necessary safety measures must be in place to protect the public. This applies before and during any building work.

Any excavation work must be fenced or otherwise guarded. This must happen before and during work to prevent danger to life or property.

The relevant building surveyor must approve safety precautions before any work begins.

The report and consent of council must be obtained for a building permit relating to the putting up of precautions over the street alignment.

Flood and Overland Drainage Report and Consent

If you apply for a building permit and the building site is on an allotment where flooding is possible, a Report and Consent is also needed.

You may need to follow specified minimum floor levels to Australian Height Datum (AHD). Consent may also contain special structural requirements.

  1. Town planning: deliver accurate and honest advice, feasibility reports for assessing the development potential of land and developed sites. Provide comprehensive and timely due diligence planning advice. Service including land and feature survey, council drawing sets, application form, planning reports till endorsed plan.

  2. Building permits: working drawing, soil test report, energy rating report, structure engineering drawing, civil engineering drawing.
  3. Pre-sell: 3D rendering, full marketing materials.
